Greenevent is to be known as the Owner. The Hirer is the Person who hires the Plant stock, Equipment, Product or Furniture.

Conditions of the hire stipulate that the Hirer must pay for full replacement cost for the lost, stolen or damaged equipment whilst on hire. Hirer must also pay for any loss Owner incurs as a result of not having available equipment/goods for future confirmed hires.

Application of a damage waiver of 3% is added to the total Invoicing cost for Hirer to pay, to cover all costs associated with general wear and tear to equipment or stock provided that the replacement cost or cost to repair does not exceed 10 % of the hiring fee for that item.

All items are hired out are at the hirers risk, any loss is to be paid for at the replacement costs, any damage is to be repaired by the owner at the hirer’s cost.

The owner will not be held responsible for any damage, or injuries to any persons caused by the plant or equipment or caused by any fault in the plant or equipment whether hidden or otherwise.

Deposit: A non-refundable deposit of minimum 50% of total Invoice amount is payable to secure your booking, with the exception of clients with existing agreements. Payment in full is required prior to product collection, with the exception of clients with existing agreements.

Cancellations: Once the tax invoice has been confirmed or 50% deposit has been paid, the hirer has agreed on the acceptance of items required for their function. No refunds will given for change of mind or reduced quantity of items less than 5 days from delivery as per the consumer guarantee, unless agreed by the owner.

Client Collections: Items on hire can be collected from our Greenevent warehouse, on the condition that a van, small truck or appropriate sized vehicle is used for transport. Utes, 4WDs & wagons with plants to be laid down are not acceptable for transportation.

Late Bookings: Our plants are kept at a Nursery in Macedon & therefore we require at least 2 days’ notice to book a job. There will be a 20% increase on total product charge for late jobs (1 day prior or day of job), to cover any additional transport or extra labour required at the last minute. Job confirmation is subject to availability of the above mentioned products, transport & labour.

INDEMNITY

The Hirer shall indemnify and keep indemnified and save harmless the Owner and the Owner’s servants and agents from all damages, suits, actions, claims and demands of every description whatsoever and howsoever arising either directly or indirectly from the use, maintenance, transport, operation of the goods or otherwise and whether resulting from the negligence of the Owner, its servants or agents or otherwise.

LIABILITY

The Hirer agrees that the use of the equipment carries with it dangers and risks of injury and the Hirer agrees to accept all dangers and risks. The Hirer hereby releases the Owner from, and agrees to indemnify the Owner and save harmless the Owner and the Owner’s servant and agents from all damages in respect of any, action, suits, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the Equipment by the Hirer or these Terms whether resulting from the negligence of the Owner, its servants or agents or otherwise.

Force Majeure: If the Owner is unable at any time to perform any of its obligations whether wholly or partly by reason of any cause beyond its control (including without limitation, acts of God, inclement weather, strikes, lockouts, fires riots, civil commotion or unrest, interference by civil or military authorities or act of war) the Owner may give written notice to that effect to the Hirer, giving full particulars of such force majeure in which case the obligations of the Owner under these Terms shall, to the extent that they are affected by the force majeure, be suspended during the term of the force majeure. The Owner shall not be liable for any loss or damage suffered by the Hirer as a result of any delays caused by such force majeure events.
